Romanian court orders the state to recognize a transgender man as male

Romania has been ordered to officially recognize the gender identity of Arian Mirzarafie-Ahi. The legal battle of the transgender man, who holds both Romanian and British citizenship, lasted several years.

Arian moved to the United Kingdom in 2008, where he later underwent gender transition and, in 2020, obtained all the necessary legal documents. However, Romanian authorities refused for years to recognize him as male, resulting in a situation where he was legally recognized as a “man” in one country and a “woman” in another.

In 2024, the case reached the Court of Justice of the European Union. The court ruled that refusing to recognize such documents violates the right to free movement within the EU, and that all member states must recognize legal gender changes completed in another member state (at the time, the United Kingdom was still part of this framework).

Arian Mirzarafie-Ahi hopes the ruling will set a precedent and simplify legal processes for thousands of others.
